Terms of Service

1. Acceptance of Terms

By downloading, installing, or using StockPulse (the “App”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately stop using the App and delete it from your device.

These Terms may be updated from time to time. We will notify you of material changes via in-app notification or email. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

2. Description of Service

StockPulse is an informational and educational mobile application that provides automated technical analysis scores (“Pulse Scores”) for a selection of US-listed stocks. The App is operated by Asian Digital Mind Limited, a company incorporated in Hong Kong.

StockPulse is not a brokerage, investment platform, or financial advisory service. The App does not execute trades, manage investments, hold funds, or act as an intermediary for any financial transaction.

4. No Guarantee of Accuracy

Market data, prices, and technical indicators displayed in the App are sourced from third-party data providers. Asian Digital Mind Limited does not guarantee the accuracy, completeness, timeliness, or reliability of any data or scores.

Data may be subject to delays, interruptions, inaccuracies, or outages caused by third-party provider failures, network issues, or other factors outside our control. Scores are algorithmically generated and are not reviewed or verified by a human financial professional.

StockPulse is not responsible for any decisions made or losses incurred based on data or scores provided by the App.

5. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You may only create one account per person. Creating multiple accounts to circumvent limitations is prohibited.
• You must be at least 17 years of age to create an account.
• You must promptly notify us at support@asiandigital.io if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions and Payments

• StockPulse offers a free tier and an optional Pro subscription.
• Pro subscriptions are billed on a recurring basis (monthly or annually) through Apple In-App Purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current paid period.
• Refunds are handled exclusively by Apple in accordance with Apple's refund policy. Asian Digital Mind Limited does not issue refunds directly.
• We reserve the right to change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App.
• Scrape, crawl, or use automated tools to access or extract data from the App.
• Redistribute, resell, or sublicense any data, scores, or content obtained from the App.
• Use the App or its outputs in connection with any form of market manipulation.
• Misrepresent any App output as professional financial advice to third parties.
• Use the App in any way that violates applicable laws or regulations.
• Attempt to gain unauthorised access to any systems, accounts, or data associated with the App.

8. Intellectual Property

All content, features, functionality, algorithms, scoring methodologies, user interface designs, branding, trademarks, and software comprising the App are owned by Asian Digital Mind Limited and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial purposes in accordance with these Terms.

Any feedback, suggestions, or ideas you provide to us may be used by Asian Digital Mind Limited without any obligation to compensate you.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED SERVICE. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Asian Digital Mind Limited and its officers, directors, employees, agents, and successors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the App; (b) your violation of these Terms; (c) any investment or trading decisions you make based on App outputs; or (d) any claim by a third party that you represented App outputs as professional financial advice.

We may suspend or terminate your access to the App at any time, for any reason or no reason, with or without notice. You may terminate your account at any time by following the account deletion process described in our Privacy Policy.

Upon termination, the following sections survive: Sections 3, 4, 8, 9, 10, 11, 12, and 14–16.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the App shall be resolved by binding arbitration administered in Hong Kong, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

Class Action Waiver: To the extent permitted by law, you waive your right to participate in any class action lawsuit or class-wide arbitration against Asian Digital Mind Limited.

15. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Asian Digital Mind Limited regarding the App and supersede all prior agreements, representations, and understandings.
